Welcome to AdvisorGenie! These Terms of Service ("Terms") govern your access to and use of the AdvisorGenie platform (the "Platform"), which includes our website, services, and any associated applications (collectively, the "Services"). By accessing or using our Services, you agree to these Terms. If you do not agree to these Terms, you may not access or use the Services.

1. Acceptance of Terms

By accessing, using, or registering for our Services, you agree to comply with these Terms and our Privacy Policy. If you are using the Services on behalf of an organization, you represent and warrant that you have the authority to bind the organization to these Terms.

2. Eligibility

You must be at least 18 years old and legally capable of entering into contracts to use our Services. By accessing the Services, you represent and warrant that you meet these eligibility requirements.

3. Services Description

AdvisorGenie provides tools and services designed to facilitate social media management, automation, and marketing for financial advisors and businesses. Features may include, but are not limited to:

  • Social media content scheduling and posting.
  • Integration with third-party platforms such as LinkedIn, Facebook, and Twitter.
  • Content creation and analysis.

We reserve the right to modify, suspend, or discontinue the Services, in whole or in part, at any time, with or without notice.

4. Account Registration and Security

You must create an account to access certain features of the Services. You agree to:

  • Provide accurate and up-to-date information.
  • Maintain the confidentiality of your account credentials.
  • Notify us immediately of any unauthorized access to your account.

You are responsible for all activity under your account. AdvisorGenie will not be liable for any loss or damage resulting from unauthorized use of your account.

5. User Responsibilities

By using the Services, you agree to:

  • Use the Services in compliance with all applicable laws, regulations, and these Terms.
  • Not misuse the Services, including but not limited to:
    • Using the Services to post or share illegal, harmful, or objectionable content.
    • Engaging in unauthorized access, hacking, or spamming activities.
    • Violating the intellectual property rights of AdvisorGenie or third parties.

AdvisorGenie reserves the right to suspend or terminate your account if we determine that you have violated these Terms.

6. Third-Party Integrations

Our Services may integrate with third-party platforms (e.g., LinkedIn, Facebook, Twitter). You acknowledge and agree that:

  • AdvisorGenie is not responsible for the content, availability, or operation of these third-party platforms.
  • Your use of third-party platforms is governed by their respective terms of service and privacy policies.

7. Intellectual Property

Ownership: All intellectual property rights in the Services, including software, trademarks, logos, and content, are owned by AdvisorGenie or our licensors.

License: We grant you a limited, non-exclusive, non-transferable license to access and use the Services for your internal business purposes, subject to these Terms.

8. Fees and Payment

If you subscribe to paid features of the Services:

  • You agree to pay all applicable fees as described at the time of subscription.
  • Fees are non-refundable unless otherwise required by applicable law.
  • AdvisorGenie reserves the right to change pricing and fees upon notice to you.

9. Disclaimer of Warranties

The Services are provided "as is" and "as available" without warranties of any kind, express or implied. To the fullest extent permitted by law, AdvisorGenie disclaims all warranties, including but not limited to:

  • Fitness for a particular purpose.
  • Non-infringement of intellectual property rights.
  • Accuracy, reliability, or availability of the Services.

10. Limitation of Liability

To the fullest extent permitted by law:

  • AdvisorGenie will not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Services.
  • AdvisorGenie's total liability for any claim arising from these Terms or the Services will not exceed the amount you paid to us in the twelve months preceding the event giving rise to the claim.

11. Indemnification

You agree to indemnify and hold harmless AdvisorGenie, its affiliates, officers, employees, and agents from and against any claims, damages, losses, liabilities, and expenses arising from:

  • Your use of the Services.
  • Your violation of these Terms.
  • Your violation of any third-party rights, including intellectual property rights.

12. Termination

AdvisorGenie may terminate or suspend your access to the Services at any time, with or without cause, and with or without notice. Upon termination, your right to use the Services will immediately cease.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of New Jersey, without regard to its conflict of law principles.

14. Changes to the Terms

We reserve the right to update these Terms at any time. If we make material changes, we will notify you by posting the updated Terms on our website. Your continued use of the Services constitutes acceptance of the updated Terms.

15. SMS Messaging Terms

AdvisorGenie SMS Program

AdvisorGenie provides an AI-powered conversational SMS service. When you text our business phone number, you may receive automated responses with information about our financial advisor marketing platform, answers to product questions, and assistance scheduling appointments.

You can cancel the SMS service at any time. Just text "STOP" to our number. After you send the SMS message "STOP" to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, simply text our number again and we will start sending SMS messages to you again.

If you are experiencing issues with the messaging program, you can reply with the keyword "HELP" for more assistance, or you can get help directly at support@advisorgenie.com.

Carriers are not liable for delayed or undelivered messages.

As always, message and data rates may apply for any messages sent to you from us and to us from you. Message frequency varies based on your interaction. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.
